Public Procurement Law

We provide legal support to both participants in public procurement procedures: contracting authorities and contractors.

We advise contracting authorities on how to prepare and conduct tenders in accordance with applicable law, particularly the PPL Act. We draft or review tender documentation, including specifications with contract drafts and other attachments. We support in clarifying specification content, entity verification, examining and evaluating bids (including abnormally low prices) and in concluding and modifying contracts in accordance with the PPL Act. We represent contracting authorities in audits (UZP, EU fund managing institutions, NIK, CBA, RIO, public finance discipline spokesperson) and in legal remedies before the National Appeals Chamber and courts. We translate experience from various sectors into practical, legally compliant solutions for contracting authorities even in very difficult situations.

We support contractors from the procedure announcement stage, analyze procurement documents, assess participation conditions and exclusion grounds, evaluation criteria, analyze contract templates for contractor risks. We challenge unfavorable provisions in tender documentation. We help prepare bids and other documents, advise on using third-party resources and in consortiums, as well as subcontracting. We effectively challenge improper contracting authority actions, including preparing and submitting appeals to the National Appeals Chamber, then complaints to court. During implementation, we support valorization, contract changes, settlements and claims, so the contract is executed in accordance with PPL and the contractor's business interest. We combine expert knowledge of regulations and case law with years of practice and reputation confirmed by handling demanding procedures.
